Terms of service

The ground rules for using this website, booking a paid consultation and using the client portal. Please read them before you pay.

Who we are

Jacinth Immigration Canada ("we", "us") is an immigration consultancy at 55 Caribou Crescent, Winnipeg, Manitoba, R3Y 0G3, Canada. Our immigration advice is given by a Regulated Canadian Immigration Consultant (RCIC) licensed by the College of Immigration and Citizenship Consultants (CICC), and we follow the College's Code of Professional Conduct.

We are not a government office. We are not part of Immigration, Refugees and Citizenship Canada (IRCC) or any provincial nominee program, and we cannot speed up or influence their decisions.

What these terms cover

These terms apply when you use this website, pay for a consultation, or sign in to the client portal. By doing any of those, you agree to them. Our refund and cancellation policy and privacy policy form part of these terms.

Information on this website

The guides, calculators, processing times, draw results and other information on this website are general information, kept as current as we can. They are not advice about your situation. Immigration rules, fees and programme criteria change often, sometimes without notice, so always check the official source or ask us before acting on them.

Using a calculator or reading a guide does not make you our client and does not create a professional relationship with us.

Paid consultations

  • A consultation is a one-on-one session with an RCIC, by video or phone, about your situation and options. Its fee and length are shown on your payment page before you pay.
  • You pay through Stripe. We never see or store your card details.
  • After payment we email you a private link to choose a time. The link is personal to you; please do not share it.
  • Rescheduling, cancellations and refunds follow our refund and cancellation policy.
  • A consultation gives you advice; it does not mean we will represent you or file anything for you. That happens only under a written service agreement (see below).

No guarantee of outcome

Every immigration decision is made by the government officer handling the application. Nobody, including us, can promise a visa, permit, nomination or permanent residence, or promise how long a decision will take. We will give you our honest professional opinion of your options and their risks, but you pay for advice and work, not for a result.

Your responsibilities

  • Give us complete, true and up-to-date information, and tell us promptly if anything changes.
  • Do not give us false documents or ask us to hide or misstate facts. Misrepresentation can lead to a refusal and a five-year ban from applying to Canada, and we will not take part in it.
  • Keep your portal sign-in to yourself and use the website lawfully.

Our advice depends on what you tell us. If the information is incomplete or wrong, the advice may be too.

When you engage us

If you ask us to prepare and submit an application or act for you, we will first agree the work in a written service agreement (retainer). It sets out what we will do, our professional fees, the payment schedule, the refund terms for that work and how either of us can end it. If the service agreement and these terms differ, the service agreement applies.

Government fees, biometrics, medical examinations, language tests, credential assessments, translations and similar costs are paid to third parties and are not part of our fees unless the service agreement says so.

The client portal

Clients get access to a secure portal to upload documents, complete forms, see payment requests and message us. Access is for you only. We may suspend access if it is misused or to protect your file, and we close it when our work for you ends, after giving you a chance to download your documents.

Our content

The text, guides, tools and design of this website belong to Jacinth Immigration Canada. You are welcome to read, print and share links to them for personal use. Please do not copy or republish them, or use them to build another service, without our written permission.

Limits on our liability

We provide the website and its general information as they are and do not promise they are always available, complete or free of errors. To the extent the law allows, we are not responsible for losses caused by relying on general website information instead of advice on your own situation, or by delays and decisions of government authorities.

For a paid consultation, our total liability to you is limited to the fee you paid for it. For work under a service agreement, that agreement sets out our responsibilities. Nothing in these terms limits any right you have under the law that cannot be limited, or our duties to you under the CICC Code of Professional Conduct.

Governing law

These terms are governed by the laws of Manitoba and the federal laws of Canada that apply there. If a dispute cannot be settled by talking to us first, it will be heard by the courts of Manitoba.

You can also raise a concern about an RCIC's conduct with the College of Immigration and Citizenship Consultants.

Changes to these terms

We may update these terms. The date at the top shows the latest version. Changes apply from that date and do not affect a consultation you have already paid for or a service agreement you have already signed.
